These Terms of Service ("Terms") govern your use of the services provided by Stone Electric ("we," "us," or "our"), including our website and any communications, such as SMS (text messaging) services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Services

Stone Electric provides professional electrical services to residential and commercial customers. Our services include, but are not limited to, electrical installations, repairs, maintenance, and consultations. We may communicate with you via phone, email, or SMS to coordinate these services.

2. SMS/Text Messaging Terms

When you provide us with your mobile phone number, you consent to receive transactional SMS/text messages from us regarding your service requests and appointments. Our SMS messaging program is designed to keep you informed about your service status.

• Program Description: We use SMS to send appointment reminders, notify you when a technician is en route, provide status updates on your service, and for other communications directly related to your electrical service request.
• Opt-In: By providing your mobile number when requesting a service, you are explicitly opting-in to receive text messages from us for transactional purposes related to that service.

• Help: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly by calling us at (720) 782-0777.
• Message Frequency: Message frequency will vary based on the services you have requested and the number of appointments or updates required.
• Message and Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
• Carrier Liability: Carriers are not liable for delayed or undelivered messages.

3. User Obligations and Conduct

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree to provide accurate and complete information when requesting services and to update your information as necessary. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.

4. Prohibited Uses

You agree not to use our services, including our SMS messaging service, for any purpose that is illegal, harmful, or otherwise violates our policies or the policies of our service providers, such as Twilio. Prohibited activities include, but are not limited to:

• Sending or promoting any content that is illegal, fraudulent, harassing, or abusive.
• Attempting to gain unauthorized access to our systems or engaging in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of our services.
• Violating any applicable laws, regulations, or industry standards, including the Telephone Consumer Protection Act (TCPA).

We reserve the right to terminate your access to our services for any violation of these prohibited uses.

5. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the services will be uninterrupted, timely, secure, or error-free. While we strive to provide high-quality electrical services, we make no warranties regarding the results that may be obtained from the use of our services.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Stone Electric shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to indemnify and hold harmless Stone Electric and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms.
